Lenox Michigan wants to adopt foreclosure ordinance

Michigan: Lenox Township officials are taking steps to try to protect homeowners from some of the negative side effects associated with a neighbor’s foreclosure.

At a recent meeting the township board discussed implementing a foreclosure ordinance to appear for a vote on a future agenda.

Protecting property values of remaining neighborhood homeowners is focus

According to the township’s attorney, Terry Welch, the ordinance would be a voluntary way for homeowners or their mortgage carriers to protect neighbors from further depreciating property values.

“It basically would require a bank or owner to voluntarily register their vacant property with the township,” Welch said.

Once a property is foreclosed on, its tax rolls are sent to the county. Because the county handles foreclosed properties there is very little a municipality could do to enforce any ordinance such as blight.

“Sometimes an ordinance just creates a deterrent,” Welch said.

Under the proposed ordinance, the bank or owner of a foreclosed property would have 30 days to register it with the township from the day it becomes vacant. An inspection of the property would be required once it becomes vacant and again upon re-occupancy.

Welch said the local law would also require the property owner to maintain the appearance of the property or risk being billed for the maintenance by the township.

Another issue regarding foreclosures, according to Supervisor Ron Trombly, is the disposal of garbage after a home becomes vacant. He said people often abandon the homes, leaving behind mounds of personal items and furniture for the banks to dispose of.

“This is in response to a problem we’ve had with foreclosed homes where the bank does not dispose of trash properly,” Trombly said.

If the refuse is not disposed of properly in a dumpster, the township’s DPW is responsible for hauling away the trash with no way to recoup the costs of doing so.

“We’re trying to put something in place where we can go after the banks,” Trombly said. “It’s a problem that’s everywhere. They’re (foreclosures) here and they’re not going away.”
